CENTRAL ADMINISTRATIVE TRIBUNAL SRINAGAR Order Sheet Item no.: 23 T.A./244/2024 (SRINAGAR) [ RETROSPECTIVE EFFECT ] SWP No.1214/2015 Court No.: 1 No of Adjournment: 12 Order Dated: 28/10/2026 MUSHTAQ AHMAD SHAH Vs GENERAL ADMINISTRATIVE DEPARTMENT
For Applicant(s) Advocate : NONE
For Respondent(s) Advocate : MR. SYED MUSAIB, DAG VICE MR. RAIS UD DIN GANAIE, DAG Order of The Tribunal It is brought to the notice of this Tribunal that the second copy of T.A. No. 244/2024 has not been furnished by learned counsel for the petitioner for a long time, which suggests that the applicant is no longer interested in prosecuting the matter. It is stated in the order dated 15.09.2026 that notice was issued to the petitioner on 15.01.2026 and 31.01.2026 but was returned with the endorsement “Insufficient Address”. Further, the applicant has remained unrepresented on the last four consecutive dates of hearing, i.e., 28.11.2025, 30.01.2026, 27.02.2026 and 15.09.2026, before the Registrar Court and has not appeared before this Tribunal even today. The facility of advancing arguments through virtual mode has also not been availed of. It is the duty of the petitioner/litigant to remain vigilant and pursue the case diligently by ensuring appearance on the due date of hearing.
The persistent absence of the applicant leaves this Tribunal with no option but to presume that the applicant has lost interest in prosecuting the matter. In view of the above, T.A. No. 244/2024 is dismissed for non- prosecution. However, the petitioner shall be at liberty to seek revival of the petition, in accordance with law, if the cause still subsists, subject to just exceptions and the response of the respondents. Accordingly, the T.A., along with all connected M.As., if any, shall stand disposed of. Interim direction(s), if any, shall stand vacated.
