ORDER

Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for Respondents 1 to 3 and the learned Counsel for State of Tamil Nadu (Criminal Side) appearing for the fourth respondent.

2. Considering the limited relief that has been sought for in the writ petition, notice to the fifth respondent is dispensed with.

3. This writ petition is filed for issuance of Writ of Mandamus, directing the respondents 2 and 3 to conduct survey and demarcate by fixing boundaries in respect of the petitioner's property comprised in Survey No. 131/A9, measuring 73 cents, Velayuthampalayam Village, __________

WP(MD) No. 30281 of 2026 Pugalur Taluk, Karur District based on the petitioner's application in petition no.2026/0123/14/002880, dated 23.09.2026, consequently direct the fourth respondent to provide adequate protection for conducting survey by considering the petitioner's representation, dated 25.09.2026 in accordance with law.

Considering the fact that the petitioner had made an application on 25.09.2026 for surveying her property, there shall be a direction to the respondents 2 and 3 to consider the petitioner's application dated 25.09.2026 and pass orders on its own merits and in accordance with law, as expeditiously as possible, after affording an opportunity of hearing to the petitioner, fifth respondent and to other interested persons, if any, in consonance with the provisions of Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923. If the respondents 2 and 3 requires the assistance of the fourth respondent, it is open to them to seek such assistance at the cost of the petitioner.

5. It is made clear that the order passed and the proceedings undertaken pursuant thereto would not confer any right to possession of the property if the same is in the hands of third parties. __________
