ORDER

This Contempt Petition has been filed against respondent for wilful disobedience of Order passed by this Court in W.P.No.9031 of 2026 dated 12.03.2026.

CONT P No. 3783 of 2026

2. Today, when the matter is taken up, the learned Government Advocate for the respondent would submit that the Order passed by this Court in the aforesaid Writ Petition has been complied with, inasmuch as, the petitioner’s property has been surveyed and demarcated by metes and bounds.

3. In reply, learned counsel appearing for the petitioner would submit that the respondent before conducting survey of the property, ought to have put on notice to the interested parties and called upon them for enquiry and after completion of such enquiry, he is supposed of pass orders, however, without resorting to such course, the respondent has straight away passed the Order.

4. However, this Court would like to point out that by virtue of the Order dated 12.03.2026 passed in W.P.No.9031 of 2026, the second respondent/contemner was only directed to consider the petitioner’s application dated 02.05.2022 made for survey, demarcation and sub-division of the petitioner’s property and to transfer patta in respect of the property and dispose of the said Application within 12 weeks and in compliance of the said Order, the second respondent, Tahsildar, the contemner herein has already disposed of the application by passing final orders. Since the application has been considered and disposed of, no cause would survive for initiation of contempt proceedings against the respondent/contemner. If at all, the petitioner is aggrieved by the order passed by the respondent/contemner, it is left open to the

petitioner to Appeal against the said Order before appropriate Forum in the manner known to law.

5. This Contempt Petition is closed with the above observations. No costs. 16-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No sd To S.Senthil Kumar Thasildar, Taluk Office, Thiruturaipoondi - 614 713,
