ORDER

(Order of the Court was made by S.M.Subramaniam J.) The order impugned dated 20.06.2026 was issued by the Executive Engineer, Zone VII of Greater Chennai Corporation in pursuance to the orders of the Division Bench of this Court dated 30.03.2026 passed in W.P. No. 6579 of 2026.

2. The present writ petitioner is the 7th respondent in W.P.No. 6579 of 2026. This Court granted liberty to respondents 7 and 8 in W.P. No. 6579 of 2026 to submit all the documents to the competent authority for consideration and the Authorities were directed to afford opportunity to all the parties and thereafter pass final orders. The said final orders passed by the Executive Engineer, Zone VII is now under challenge in the present writ petition.

3. Reading of the order of the Executive Engineer would show that after obtaining necessary approval from the Regional Deputy Commissioner (Central), for removal of the encroachment, the authorities concerned shall initiate appropriate enforcement proceedings to remove the encroachments as per due process of law.

WP No. 31710 of 2026

4. The said instruction given by the Executive Engineer would not constitute cause for institution of present writ petition. The enforcement action is not yet commenced.

5. Learned Standing Counsel would submit that report of the Revenue Tahsildar is awaited and on receipt of the same, Corporation will initiate enforcement actions for removing encroachment.

6. Thus, the present writ petition is premature and no cause of action has arisen. If at all enforcement action is initiated based on the report of the Revenue Tahsildar or the competent authority, the petitioner is at liberty to defend her case. However, the present writ petition is not entertainable and stands dismissed. No costs. Consequently, the connected miscellaneous petitions, if any, are closed. (S.M.S.,J.)
