ORDER
(Order of the Court was made by N.Sathish Kumar J.) Challenging the notices issued by the 4th respondent dated 10.09.2026, 18.09.2026 and 10.10.2026, calling upon the petitioner resort to discontinue the use of the land/building, the present writ petition has been filed.
2. It is the contention of the learned Senior Counsel appearing for the writ petitioner that, when the matter related to illegal resorts in Anaikatti area came before this Court on 21.08.2026 in W.P.No.27356 of 2019, the official respondents filed a status report therein admitting that the petitioner resort has been running with all proper licence and the same was recorded by this Court in
WP No. 42833 of 2026
the order dated 21.08.2026. However, after the said order, now the impugned notices have been issued by the respondents as if the petitioner resort has not obtained the requisite licences.
3. Mr.K.Surender, learned Special Government Pleader, who takes notice for the respondents 1 to 4, on instructions, would submit that, though a report had been filed before this Court on 21.08.2026 in W.P.No.27356 of 2019 as if the petitioner resort has got all the licences, on proper verification, it is now found that the petitioner has not obtained the licence from the Hill Area Conservation Authority (HACA). He would further submit that the petitioner has now sought for regularisation, which is pending.
4. Therefore, admittedly, the petitioner is not in possession of all the valid licences as per law. In such view of the matter, since the respondents have already sent notices to the petitioner, it is for the petitioner to produce all the valid licences and documents available with them before the respondents and if the authorities find that the petitioner has got all the valid licences and permissions in accordance with law, they shall pass necessary orders and in the event if there is no valid building licence or permission or if there is any violation, let the authorities take action as against the petitioner in accordance with law.
WP No. 42833 of 2026
5. With these directions, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
6. For filing a report as to the action taken in the matter by the respondents, post the matter on 13.11.2026. (N.S.K.,J.) (D.L.,J.) 16-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No MKN To
