COMMON ORDER
This Writ Petition is filed challenging the rejection orders passed by the 4th respondent, viz., the Zonal Deputy Tahsildar, Paramathi, Vellore Taluk, Namakkal District dated 08.08.2026, 10.08.2026 and 20.08.2026 and
07.08.2026, 10.08.2026 and 21.08.2026 respectively and to quash the same, and consequently, to direct the respondents to consider the applications of the petitioners and grant mutation of revenue records as per Sale Deed bearing Document Nos.2914 & 2913 of 2024 dated 18.06.2024 and issue Patta based on the documents submitted by the petitioners.
2. The case of the petitioners, as stated in the affidavit, filed in support of this Writ Petition in short, is as follows:-
i) The petitioner in W.P.No.42901 of 2026 and her husband (petitioner in W.P.No.42924 of 2026 made applications via. online to the fourth respondent seeking for mutation of the revenue records and for issuance of patta in respect of the property owned by them. However, the fourth respondent rejected the applications by merely sending a text messages to the mobile numbers of the petitioners. Challenging such rejection, the petitioner has approached this Court by way of present Writ Petition.
3. The learned Senior Counsel appearing for the petitioners would submit that rejection simpliciter, viz., without assigning any reasons, that too, on the ground that the Civil Suit is pending, is contrary to the judgment rendered by this Court in W.P.No.7844 of 2021 dated 26.03.2021 in the case of V.P.Chinnasamy Vs. The R.D.O. and another).
3.1 The learned Senior Counsel for the petitioner would further submit that once the application is made for issuance of patta, the Authority concerned cannot wriggle out of their duties and reject such application on the sole ground that the Civil Suit is pending, without citing any valid reasons.
4. The learned Additional Government Pleader for the respondents would submit that since a civil suit is pending between the petitioners and some third parties in respect of the same property, the petitioners application have been rejected, however, it is fairly submitted that any direction is issued by this Court, the same would be complied with.
5. Heard the learned Senior Counsel appearing for the petitioners and the learned Additional Government Pleader for the respondents.
6. As rightly pointed out by the learned Senior Counsel for the petitioners, when an application is made before the Tahsildar seeking for issuance of patta, he being an Administrative Authority, either has to grant the relief or in case of rejection, ought to assign reasons for such rejection, and before doing so, is expected to put on notice to the petitioners and verify the documents regarding the ownership over the property, with respect to which, patta is sought for and without adhering to the principles of natural justice without assigning any reasons, such rejection is not contemplated. In the present case, the petitioners have made such applications before the fourth respondent, however, fourth respondent viz., without assigning any reasons, merely citing the pendency of the civil suit, rejected the said applications. Since the applications have already been made, it is for the fourth respondent to dispose of the same either by way of granting the prayer or negativing the relief, and rejection of the application without assigning reasons, is untenable. 7, With the above observations, this Writ Petition is disposed of. The said consideration and disposal of the Applications shall be within a period of six weeks from the date of receipt of a copy of this order. It is made clear that, either grant or refusal of the prayer sought in the applications shall be followed with a detailed order assigning valid reasons. Needless to say, while disposing the application, all the parties shall be put on notice. It is also made clear that direction issued to the fourth respondent to entertain the applications filed by the petitioners and dispose of the same on merits would not per se mean that direction is given to issue patta to the petitioners. No costs. Consequently, connected miscellaneous petitions are closed. 16-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No sd
