PRAYER: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of MANDAMUS directing the respondents 1 to 3 to remove the illegal encroachments put up by the 4th respondent in the public lane comprised in T.S.No 38 and 39 situated at Block No.7, Ward M, Dhamalavarubayam village, Ko-Abhisekhapuram Division, Trichy West Taluk, Trichy City in the light of proceedings issued by the 3rd respondent in Na.Ka.No.A1/660/2026 dated 03.07.2026
within the time stipulated by this Court.

ORDER
(Order of the Court was made by G.R.Swaminathan J.) Heard both sides.
2. The writ petitioner is a resident of Woraiyur. According to her, there are encroachments in the petition-mentioned survey numbers. She wants the same to be removed. __________

3. When the matter was taken up for hearing, the learned counsel for the authority submitted that T.S.No.38 has been classified as “Santhu / lane”, while T.S.No.39 has been classified as “Poosthithi saalai”.
4. The learned counsel for the fourth respondent asserted that T.S.No.38 is not a public lane but it is a private lane.
5. We, therefore, direct the fifth respondent to conduct summary enquiry. If the fifth respondent decides to conduct a survey, the local police shall provide protection to ensure that no false allegations are made against the officials. The officials should be allowed to discharge their functions freely. Any person obstructing the officials in discharging their functions will face contempt proceedings before this Court.
6. If the fifth respondent is satisfied that the lane in question is a public lane, then the encroachments shall be removed by adopting due process of law. The entire process should be completed within a period of four months from the date of receipt of a copy of this order. The revenue authorities are obliged to assist the corporation officials in conducting the survey. __________
