measuring 0-17.40 Hectares (43 cents), situated at Sindhupoondurai Village, Manimoortheeswaram, Part-II, Thatchanallur Town, Tirunelveli Taluk, Tirunelveli District, pursuant to the application submitted by the 2nd petitioner and upon payment of the prescribed survey charges paid on 03.09.2026, and consequently direct the 3rd respondent, to provide adequate and effective police protection for peacefully conducting and completing the survey, measurement and demarcation within a time frame to be stipulated by this Court.

ORDER
Heard learned counsel appearing on either side.
2. By consent of both parties, this Writ Petition is taken up for final disposal.
3. This Writ Petition is filed for issuance of Writ of Mandamus to direct the respondents 1 and 2 to survey, measure and demarcate the properties comprised in T.S.No.1607 measuring 0-34.80.0 Hectares (86
WP(MD) No. 30023 of 2026 cents), T.S.No.40 measuring 0-21.45.0 Hectares (53 cents), T.S.No.1609 measuring 0-17.40 Hectares (43 cents), situated at Sindhupoondurai Village, Manimoortheeswaram, Part-II, Thatchanallur Town, Tirunelveli Taluk, Tirunelveli District, pursuant to the application submitted by the 2nd petitioner and upon payment of the prescribed survey charges paid on 03.09.2026, and consequently direct the third respondent, to provide adequate and effective police protection for peacefully conducting and completing the survey, measurement and demarcation within a time frame to be stipulated by this Court.

Considering the fact that the petitioners had made applications as early as on 03.09.2026 and 07.10.2026 for surveying the property, there shall be a direction to the first respondent to consider the petitioners' applications dated 03.09.2026 and 07.10.2026 and pass orders on its own merits and in accordance with law, in consonance with the provisions of Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923, within a period of twelve (12) weeks from the date of receipt of a copy of this order. If the first respondent requires the assistance of the third respondent, it is open to him to seek such assistance at the cost of the petitioners.

5. It is made clear that the order passed and the proceedings undertaken pursuant thereto would not confer any right to possession of the property if the same is in the hands of third parties.
