CENTRAL ADMINISTRATIVE TRIBUNAL ERNAKULAM Order Sheet Item no.: 28 O.A./288/2021 (ERNAKULAM) [ ABSORPTION ] Court No.: 2 No of Adjournment: 1 Order Dated: 29/10/2026 J AJITH Vs SOUTHERN RAILWAY For Applicant(s) Advocate : Mr. Martin G. Thottan For Respondent(s) Advocate : Mr. N.K. Subramanian Notes of The Registry Order of The Tribunal

The challenge in the Original Application is against Annexure A-3 order dated 29.01.2021, whereunder the applicant, on being medically decategorised and absorbed in the post of Ticket Examiner was granted pay matrix in Level 3. Later, that was sought to be reviewed and absorption in Level 2 is proposed which is under challenge in the Original Application. Accordingly, he was directed to appear for a screening test. The OA has been opposed by the respondents. Meanwhile, the applicant filed rejoinder along with Annexure A-6 communication issued by the Railway Board dated 14.10.2019 which deals with fixation of pay of disabled/medically unfit running staff on being appointed against alternative (Stationary) posts in revised (7th CPC) pay structure. After filing of the rejoinder along with additional documents, the respondents did not file any additional reply statement. As rightly pointed out by the learned Counsel for the applicant, in the nature of the contentions raised by the applicant, it is necessary that additional reply statement is warranted touching Annexure A-6 series documents. It is seen that, following the communication of the Railway Board dated 14.10.2019, Central Railway has issued a communication on 11.11.2021 which contains a table showing posting of medically decategorised running staff in identical pay scale in the 7th CPC. In the circumstances, respondents are directed to file additional reply statement within 10 days. Adjourned to 13.11.2026.
