ORDER

(Order of the Court was made by G.R.Swaminathan J.) Heard the learned counsel for the petitioner and the learned Government Advocate for R1 to R3.

2. What is under challenge is a notice under Section 7 of the Act. Such notice is neither a decision nor order. We have already held that it

WP(MD) No. 30113 of 2026 is not amenable to appeal under Section 10 of the Act. If it is not appealable, the question of impugning it under writ jurisdiction will not arise at all. Of-course, if the very issuance of notice is without jurisdiction, the party can come before us. That is clearly not the case. Be that as it may, the petitioner has given some objections on 11.09.2026.

3. The third respondent is directed to conduct a summary enquiry and consider the petitioner's objections and then pass an appropriate order. The Writ Petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petitions are closed. (G.R.S.,J.) (M.D.S.,J.) 16-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No rmi To
