ORDER

(Order of the Court was made by G.R.Swaminathan J.) Heard both sides.

2. The third respondent felt aggrieved by the compound wall put up by the Nallathangal Swamy Temple, Kattikulam. Eviction order was passed and an appeal was also filed. The appellate authority while disposing of the appeal passed a blanket order against few other temples located in the same survey number. In fact, the petitioner temple is one such. It is not in dispute that the said temple is under the separate management. Therefore, separate notices should have been given, if at all. In an appeal filed by the Nallathangal Swami Temple, an adverse order could not have been passed against another temple. This amounts to violation of the principles of natural justice.

WP(MD) No. 7178 of 2026

3. The impugned order is set aside insofar as the petitioner is concerned. The Writ Petition is allowed accordingly. No costs. Consequently, connected miscellaneous petitions are closed. (G.R.S.,J.) (M.D.S.,J.) 16-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No rmi To
