ORDER

This Writ Petition has been filed seeking a direction to respondents 1 to 5 to take appropriate action against the sixth respondent and to cancel Patta No. 525, which was allegedly issued in the sixth respondent's favour, by considering the petitioner's representation dated 14.07.2026.

2. The case of the petitioner is that the property comprised in Survey No. 531/16, situated at Balreddy Kandigai Village, Tharatchi Post, Uthukottai Taluk, Tiruvallur District, originally belonged to his ancestors. According to the petitioner, the property subsequently devolved upon his father, who executed a Settlement Deed dated 04.06.2015 in favour of his son, Mr. V. Abhinav Prabhu, conveying an extent of 3,338 sq. ft. in Survey No. 531/16A. Pursuant to the said settlement deed, Patta No. 1322 was duly issued in the name of the beneficiary.

3. The petitioner further submits that the sixth respondent, claiming rights over the adjacent property comprised in Survey No. 531/16B, obtained Patta No. 525 in his name based on a Settlement Deed dated 10.05.1990, registered as Document No. 536 of 1990. The petitioner disputes the genuineness of this deed, alleging that the patta was secured through fabricated documents, thereby detrimentally affecting the petitioner's family's property rights.

WP No. 42455 of 2026

4. According to the petitioner, on 09.07.2026, an official from the Village Administrative Officer's (VAO) office visited the locality to conduct a property survey. Upon inquiring, the petitioner discovered the existence of the patta standing in the name of the sixth respondent. Consequently, the petitioner submitted a representation dated 14.07.2026 to respondents 1 to 5, requesting them to examine the relevant revenue records, take appropriate action against the sixth respondent, and cancel Patta No. 525. Since no action was taken on the said representation, the petitioner has preferred the present Writ Petition.

5. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing on behalf of the respondents and perused the records.

6. Considering the nature of the relief sought by the petitioner, this Court is of the view that the petitioner's representation requires due consideration by the competent authority after verifying the relevant revenue records and the documents relied upon by both parties. Since the petitioner has raised a specific dispute regarding the validity of the source documents used to issue Patta No. 525, the matter must be examined by the competent authority in accordance with law, ensuring a fair opportunity of hearing to the petitioner, the sixth respondent, and any other interested parties.

WP No. 42455 of 2026

7. Accordingly, without expressing any opinion on the merits of the rival claims or the genuineness of the documents in question, this Writ Petition is disposed of with a direction to the third responden, the Revenue Divisional Officer (RDO), Tiruvallur Distric, to consider the petitioner's representation dated 14.07.2026, examine the relevant land and revenue records, and pass appropriate orders on merits and in accordance with law within a period of eight

(8) weeks from the date of receipt of a copy of this order, after affording a fair opportunity of a personal hearing to the petitioner, the sixth respondent, and any other necessary or affected parties, who are sequentially directed to produce all original and relevant title deeds, parent documents, and revenue records supporting their respective claims as and when required; furthermore, it is made clear that this Court has not expressed any opinion regarding the title to the property, the genuineness of the disputed settlement deed (Document No. 536 of 1990), or the validity of the patta standing in the name of the sixth respondent, leaving the third respondent to adjudicate the matter independently and strictly on its own merits. No costs. Consequently, connected miscellaneous petition is closed. K.SURENDER J. 15-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No JAI
