ORDER

The writ petition has been filed seeking direction to the second respondent to survey and fix the boundaries of the petitioner's lands situated in R.S. Nos. 58/1B, 58/3A, 58/3B and 58/3D of Nathakadaiyur Village, Kangeyam Taluk, Tiruppur District, pursuant to the online application bearing No. 2026/0123/32/002790 dated 03.09.2026.

WP No. 42588 of 2026

2. The case of the petitioner is that she purchased the aforesaid lands, measuring a total extent of 2 acres and 14 cents, under a registered sale deed dated 09.07.2024. Pursuant to the purchase, she claims to be in possession and enjoyment of the properties and has also obtained individual pattas bearing Nos. 5151 and 5215. In order to ascertain and fix the boundaries of the said lands and avoid disputes with neighbouring landowners, she submitted an online application dated 03.09.2026 before the second respondent and paid the prescribed survey fee of Rs.3,260/-. However, despite repeated personal requests, the second respondent has neither conducted the survey nor disposed of the application. Hence, the present writ petition has been filed.

3. The learned counsel for the petitioner submits that the application has been pending without any valid reason, despite payment of the prescribed fee. It is therefore submitted that a direction may be issued to the second respondent to conduct the survey and fix the boundaries of the petitioner's lands within a stipulated time.

4. The learned Special Government Pleader appearing for the respondents submits that the petitioner's application will be considered in accordance with the applicable rules and procedures. It is further submitted that the survey can be undertaken after verifying the relevant revenue records and after issuing notice to the concerned adjoining landowners, wherever necessary.

WP No. 42588 of 2026

5. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents and perused the materials available on record.

6. Considering the limited nature of the relief sought for, this Court is of the view that the petitioner's application dated 03.09.2026 requires consideration by the second respondent in accordance with law.

7. Accordingly, the second respondent is directed to consider the petitioner's online application bearing No. 2026/0123/32/002790 dated 03.09.2026, verify the relevant records, issue notice to the petitioner and the concerned adjoining landowners, wherever necessary, and conduct the survey to ascertain and fix the boundaries of the subject properties, in accordance with law. The entire exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order.

8. It is made clear that this Court has not expressed any opinion on the merits of the petitioner's claim regarding the boundaries of the subject properties, and the same shall be determined by the competent authority in accordance with law.
