Prayer : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of CERTIORARIFIED MANDAMUS, to call for records pertaining to the impugned order in Letter No.Ko.02/2026/U.Po.Town Section No.1 dated 15.09.2026 and the impugned order in Letter No.Ko.02/2026/U.Po.Town Section No.1 dated 06.10.2026 on the file of the respondent No.4 and quash the same as illegal and consequently for a direction, directing the respondents to conduct a comprehensive survey in the entire extent of the water body in S.No.25, Vendakottai Village, Pattukottai Taluk, Thanjavur District by way of issuing Form I, II, III notices to all the alleged encroachers including the petitioner and uniformly evict all the encroachments after receiving the objections in accordance with law.

ORDER
Heard both sides.
2. There is no need to interfere with the impugned orders. This is because the stand of the authorities is that if the petitioner on his own does not remove the encroachments, they would take action as per the Tamil Nadu Protection of Tanks and Eviction of Encroachment Act, 2007.

3. No exception can be taken to the stand of the authorities. In fact, the petitioner himself has given an undertaking that he would remove the encroachment committed by him because in the survey conducted by the authorities, it was noticed that his septic tank comes within the water body area. Be that as it may be, we direct authorities to adhere to the statutory procedure. This writ petition stands disposed of accordingly. No costs.
