CENTRAL ADMINISTRATIVE TRIBUNAL JABALPUR Order Sheet Item no.: 49 O.A./921/2026 (JABALPUR) [ TRANSFER ] With M.A./1366/2026 FOR URGENT HEARING Court No.: 1 No of Adjournment: 4 Order Dated: 29/10/2026 NITESH SINGH Vs REVENUE
For Applicant(s) Advocate : Shri Manoj Sharma, Sr. Advocate through V.C assisted by Ms. Shrunkhala Darekar
For Respondent(s) Advocate : Shri Surendra Pratap Singh Order of The Tribunal M.A No. 1366/2026 filed by the applicant's counsel for urgent hearing of the matter is allowed and the matter is taken up today. MA No. 1367/2026 has been filed by the applicant's counsel to restrain the respondents from taking any coercive action against the applicant pursuant to the Notice dated 12.10.2026 (Annexure MA- 4). Learned counsel for the applicant has stated that despite the fact that vide order dated 28.09.2026 this Tribunal as an ad-interim measure directed the respondents to maintain status quo, the respondents have issued a show cause notice vide communication dated 12.10.2026 (Annexure MA-4) seeking his reply as to why he has not joined at Raipur as yet. Thus, the learned counsel for the applicant has submitted that the action of the respondents is violative of the direction of the Tribunal and prayed to stay the operation of the same.
On the other hand, the learned counsel for the respondents has opposed the MA and submitted that applicant has already filed his reply to the said notice. Therefore, the operation of the said communication cannot be stayed at this stage. Having heard both the learned counsel for the parties, I am of the considered view that the respondents have mis-interpreted the order dated 28.09.2026 in their favour and have issued show cause notice dated 12.10.2026 to the applicant. Therefore, the respondents are directed not to take any coercive action against the applicant pursuant to the show cause notice dated 12.10.2026 till the next date. The learned counsel for the respondents is directed to file reply before the next date. List on 23.12.2026. Smt Mallika Arya Member (A) Anand Dubey ( ps )
