ORDER

The present petition has been filed by the sole accused in STC No. 574 of 2026, pending on the file of the learned Judicial Magistrate No. II, Nagercoil, Kanniyakumari District, seeking to quash the charge sheet, wherein the petitioner is charged with offences under Sections 296(b), 130, and 351(2) of the BNS, 2023.

2. A perusal of the charge sheet reveals that the petitioner is alleged to have threatened the defacto complainant to withdraw another complaint registered in Crime No. 218 of 2025.

3. According to the learned counsel appearing for the petitioner, no such incident had taken place and the complaint in question had been falsely lodged by his neighbour.

CRL OP(MD) No. 23520 of 2026

4. Heard the submissions made on either side and perused the materials available on record.

5. It could be seen from the charge sheet that the petitioner had threatened the defacto complainant to withdraw another FIR registered against him. In such circumstances, this Court finds no valid ground to quash the charge sheet, and the present petition is devoid of merits. However, considering the age of the petitioner, his personal appearance before the trial Court is dispensed with, unless specifically directed by the trial Court.

6. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petitions are closed. 14-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No gvn
