ORDER

The petitioner is the father of the minor, Aarna Amar, who is the owner of an immovable property being residential flat bearing No.A5, First Floor, Block B, measuring 1218 sq.ft super built up area, along with one covered car park at Muttukadu Village, Thirupporur Taluk, Chengalpet District. The petitioner has filed the instant original petition, seeking permission to sell the said property belonging to the minor, Aarna Amar, to utilise the profits for the upkeep and maintenance of the minor.

2. Heard the learned counsel for the petitioner.

3. I have also gone through the evidence adduced by P.W.1 before the learned Master on 28.09.2026. The petitioner has examined himself as P.W.1 and has marked Ex.P1 to Ex.P8. The petitioner has stated that the he is a permanent resident of Royapettah, Chennai and it is becoming very difficult to take care of the property, which is situate in Muttukadu village and the prices have also saturated and maintaining the property hereafter is going to be a burden for the him, which will affect the interest of the minor daughter. The learned counsel for the petitioner also states that the sale is only in the interest and economic advantage of the minor daughter of the petitioner. He also brings to my notice that the buyer is willing to purchase the property at Rs.95,00,400/-

and the petitioner, as father and natural guardian, has affirmed that the consideration offered by the purchaser is the prevailing market rate.

4. In fact, the valuation report of RVJ Associates has also been marked as Ex.P3. Considering the location and extent of the property, I am satisfied that the consideration proposed for the sale of the property is commensurate to the prevailing market rates in the said locality and as contended by the learned counsel for the petitioner, the sale of the property would be in the best economic advantage of the minor. In the light of the above, I am inclined to allow the original petition as prayed for by the petitioner.

5. This Original Petition is allowed. The petitioner is permitted to seel the schedule mentioned property of the minor, Aarna Amar and to present, execute and register necessary conveyances. However, this Court will not permit the entire sale consideration to be utilised for the educational purposes of the minor. The petitioner is permitted to wisely invest the sale consideration, subject to payment of applicable taxes in good return yielding safe mutual funds. The petitioner shall be entitled to withdraw the profits/interest once in every three months. The principal amount invested shall remain intact and shall be preserved in full, to be made available for transfer to the minor, upon the minor attaining the age of majority.
