2. Though the matter has been referred to the learned Master and has come back for want of certain original documents.

3. On going through the petition averments and also after hearing the learned counsel for the petitioners, I deem it unnecessary to refer the matter back to the learned Master.

4. This petition has been filed for grant of Succession Certificate in respect of the debts in the name of late M.Narayanaswamy. The 1st petitioner is the wife of the deceased M.Narayanaswamy. The petitioners 2 and 3 are sons of late M.Narayanaswamy. The 4th petitioner is the grandson of the deceased M.Narayanaswamy and the 5th petitioner is the granddaughter of the deceased M.Narayanaswamy through the predeceased son, Jai Shankar. The petitioners are surviving class I legal heirs of late M.Narayanaswamy.

5. It is the categorical assertion of the petitioners that M.Narayanaswamy died intestate on 14.05.2003 and he had invested monies and the amounts are payable to the said M.Narayanaswamy by the Corporation of Chennai to the tune of Rs.5.42 lakhs or thereabouts. The Corporation of Chennai has requested the petitioners to obtain a Succession Certificate to enable release of said funds to the petitioners, being the legal heirs of the deceased M.Narayanaswamy.

6. In fact, the deceased was employed with Ambattur Municipality as an Office Assistant and the amounts that are due and payable to him are his retirement benefits alone. The petitioners have also effected general paper publication, pursuant to the orders of this Court and necessary succession duty has also been paid. In the light of the above, I am satisfied that the petitioners are entitled to Succession Certificate as prayed for.

7. The petitioners have specifically requested for the grant in favour of the 1st petitioner, the wife of the deceased M.Narayanaswamy.

8. In fine, This Original Petition is allowed and the Succession Certificate shall be issued in favour of the 1st petitioner, wife of the deceased M.Narayanaswamy, to collect the debts and to receive the interest, specified in the schedule annexed.
