PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the order dated 03.04.2017 passed by the 2nd respondent in his proceedings Manu.No.127/X1/2014 and the consequential order dated 12.06.2017 passed by the 3rd in his proceedings in Na.Ka.A3/118/2017
and quash the same as illegal, consequently direct the respondents 1 & 2
to deposit the compensation amount before the civil court to enable the parties to get a judgment of title over the property.

ORDER
Pending writ petition, the first petitioner died and petitioners 2 to 8, who are his legal heirs, were brought on record.
2. Heard the submissions made by the learned counsel and carefully perused the material available on record.
3. The lands that is subject matter of this writ petition had been acquired by the Government for establishment of a SIPCOT for industrial purposes and the compensation amount had been deposited with the Reference Court.
4. The present writ petition challenges the proceedings of the Revenue Divisional Officer, Srirangam, Trichy District for transferring the patta in favour of respondents 5 to 8 by canceling the patta which stood in the name of the first petitioner and others.
5. This would denote that there is a dispute with regard to the title of the property. In normal course, parties would be directed to approach __________

WP(MD) No. 12372 of 2017 the civil Court for appropriate remedy. However, considering the fact that the lands have been acquired and amounts have been deposited in the Reference Court, the Reference Court under the provisions of Section 31 of the Land Acquisition Act is also entitled to decide the title of the properties for disbursing the amount of compensation that had been fixed by the Land Acquisition authority.
6. In that regard, with liberty to the respective parties to substantiate before the Reference Court, to establish the right for receipt of compensation in the pending RFCT OP.No.231 of 2021, this writ petition stand disposed of.
