PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned order passed by the 3rd respondent vide Na.Ka.No.A2/6443/2024 dated 24.06.2025 and quash the same as illegal and consequently direct the respondents to restore the order passed by the 3rd respondent vide his proceedings in Na.Ka.No.
A2/6443/2024 dated 23.06.2025 within the time frame that may be fixed by this Court.

ORDER
The present writ petition has been filed challenging an order dated 24.06.2025 passed by the third respondent in Na.Ka.No.A2/6443/2024, whereby the third respondent set aside his earlier order dated 23.06.2025, in and by which he had acknowledged that the roads shown in the layout of the fourth respondent belonged to the Government and had consequently permitted the public to use the said roads. __________

2. Admittedly, the lands are situated within a village Panchayat and governed by the Tamil Nadu Panchayats Act. The Panchayat is being administered by elected representatives under the provisions of the Panchayats Act and in that regard, management of the village Panchayat is being carried out by the elected representatives.
3. It is also an admitted fact that the pathway declared for public use falls within a market established by the fourth respondent on its own lands. In such circumstances, declaring a portion of the said land for public use would violate the mandate of Article 300-A of the Constitution of India.
4. That apart, the third respondent, who is the Block Development Officer of the said village Panchayat also do not have any authority to declare a land to be a public pathway to be used by the general public.
5. In that regard, even though various reasons have been attributed for recalling his earlier order, without entering upon the merits of the same, this Court do not find any merit in the writ petition. __________
