CENTRAL ADMINISTRATIVE TRIBUNAL MUMBAI Order Sheet Item no.: 19 M.A./1020/2026 (MUMBAI) [ EXTENSION OF TIME ] [ SENIOR CITIZEN ] In O.A./1152/2023 COMPASSIONATE APPOINTMENT Court No.: 2 No of Adjournment: 1 Order Dated: 29/10/2026 WESTERN RAILWAY Vs SMT SUREKHA BARKIA PATIL

For Applicant(s) Advocate : Mrs. N V Masurkar For Respondent(s) Advocate : Mr. Suhas Mandal h/f Sarvahita Legal Order of The Tribunal MA No. 1020/2026 has been filed by the applicant for extension of time to comply with the order dated 06.11.2025 passed in OA No. 1152/2023.

2. It is stated that the respondents have duly processed the case for implementing the order of the Tribunal. For the reasons that the case of applicant is more than 27 years old, which in terms of RBE 21/2023, requires a referral to Railway board along with approval of age relaxation due to an out dated OBC certificate. This administrative procedure is made through HQ to Railway Board which requires significant amount of time to implement the judgement. The case has been referred to Headquarters for further approval through Railway Board to consider the case. 2.1 In view of the above, the judgement/order passed by this Tribunal needs some significant time for approval from competent authorities at Ministry level and the Respondents are duty bound to comply with the order of the Tribunal, which is under active consideration. However, the judgement/order dated 06.11.2026 could not be complied within the time limit as directed by this Tribunal and the time limit expired on 04.06.2026 Thus, there is a delay of ninety days in complying the order of the Tribunal. Therefore, this Tribunal may be pleased to condoned the delay in filing this Miscellaneous Application. 2.2 In view of the above, the Department is praying for extension of time.

3. On the basis of advance copy of the application, Shri Suhas Mandal appears on behalf of the original applicants and submits that although sufficient time has already been passed for implementation of the order, therefore, there is no ground available for extension.

4. After hearing learned counsel for the parties and after taking note of the consideration, the submission of facts mentioned in para 4 & 5 of the application, MA is allowed and the Department is directed to implement the order passed by this Tribunal in OA No. 1152/2023 up to 31.01.2027.
