JUDGMENT

(Judgment of the Court was delivered by N.Sathish Kumar J.) Challenging the order of the learned Single Judge in A.No.3013 of 2020 in C.S.No.242 of 1986 dated 19.12.2022, the present appeal has been filed.

2. In the order impugned, the learned Single Judge took note that Tamil Nadu Vanniyakula Kshatriya Public Charitable Trusts and Endowments (Protection and Maintenance Act, Act No.44 of 2018) has came into existence, however, the same has not been challenged and further, the interim order passed by this Court in A.No.1617 of 2020 for appointment of trustees in temporary basis is correct and further, the learned Single Judge also directed the parties place the audit report before this Court.

3. The challenge in this appeal is mainly with regard to the appointment of trustees. According to the Party-in-Person, there is a violation to the scheme decree and the Government appointing the trustee is not proper.

4. Heard both sides and perused the materials placed on record.

5. We are of the view that nothing survives for adjudication in this appeal, since the period of appointment is already over and several appointments have already been taken place. As admitted by both sides, present appointments will also expire on 12.11.2026. Such being the position, the new appointment should be properly done as already directed by this Court.

6. Now, the power is vested with the Board as directed by this Court in view of Vanniyakula Kshatriya Public Charitable Trusts and Endowments (Protection and Maintenance Act, Act No.44 of 2018). In such view of the matter, the trustees should be appointed purely on the basis of law which is in existence. Hence, we do not find any merits in this appeal since the period is already over and nothing survives for adjudication in this appeal.

7. Accordingly, this appeal stands disposed of. No costs. Consequently, connected miscellaneous petitions stand closed. If at all the appellant wants to agitate his rights, liberty is granted to the appellant to file necessary application before the learned Single Judge. (N.S.K.,J.)
