ORDER

The writ petition is filed seeking a mandamus to the first respondent to dispose of the appeal in Reference No.4300/G/2019 filed by the second respondent, within a time frame to be fixed by this Court.

2. The petitioner is a Chit Company and the second respondent is its subscriber. The second respondent subscribed to Chit No.1108 of 2012 for Rs.30,00,000/- payable in 30 monthly instalments of Rs.1,00,000/- each. He was declared as the successful bidder in the 15th auction held on 27.10.2013, and became entitled to receive Rs.23,99,000/- after the auction discount. However, after paying the 27th instalment, he defaulted on subsequent payments, resulting in arbitration proceedings under Section 64 of the Tamil Nadu Chit Funds Act, 1982, in A.R.C. No.126 of 2015, seeking recovery of Rs.3,82,661/- with interest and costs. Notices were issued to the second respondent and his sureties, and the second respondent's properties were attached before judgment. Despite sufficient opportunities, the second respondent failed to contest the arbitration proceedings, and therefore, an award was passed on 07.06.2017.

3. Challenging the award, the second respondent filed a statutory appeal

WP No. 40614 of 2026

in Ref.No.4300/G/2019 before the first respondent against the petitioner, and had obtained an interim stay on 05.08.2019. The petitioner had submitted several representations to the first respondent for early disposal of the appeal and the last one was on 19.12.2025. Since the appeal remained pending for a long time, the present writ petition is filed seeking a direction to the first respondent to dispose of the appeal expeditiously.

4. Heard the learned counsels on either side and also perused the materials placed on record.

5. The limited scope of prayer sought for in this writ petition is to dispose of the appeal filed by the second respondent in Ref. No.4300/G/2019 against the petitioner. Since the said appeal is pending on the file of the first respondent from 2019, a mandamus is issued to the first respondent to dispose of the appeal within a period of four weeks from the date of receipt of a copy of this order.

6. With the above directions, the writ petition is disposed of. No costs. 12-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No DS
