ORDER

The writ petition has been filed seeking the following relief : " To direct respondents 1 to 5 to consider and dispose of the petitioners application dated 1.08.2026 made under section 15 of the Registration of Births and Deaths Act, 1969 read with Rule 11 of the Tamil Nadu Registration of Births and Deaths Rules, 2025 in respect of Birth Registration No.B-2025:33-21360-000489 dated 10.03.2025 within such time as this Court may be pleased to fix, and

consequent thereupon, to direct respondents 1 to 5 to issue to the petitioner a single corrected birth certificate in respect of the said Registration No B-2025:33-21360-000489 showing the name of the child, the name of the mother, and the column relating to the name of the father left blank."

2. The petitioner is the single parent of the female child born to her on 24.02.2025 at Kilpauk Medical College Hospital, Chennai. In the birth register maintained in the hospital, the petitioner's name is correctly entered as the mother of the child, however, in the column denoted for father, the name of the sixth respondent namely Antony Raj is entered, who accordingly to the petitioner, he is neither her husband nor the father of the child. He only accompanied the petitioner to the hospital at the time of admission. Even the hospital records shows the address of the sixth respondent, however, the petitioner denied that she never resided in the said address. Based on the birth report furnished by the hospital, the sixth respondent's name was shown as the father of the child in the Register of Births.

The petitioner would contend that her earlier marriage was dissolved by a decree of divorce on 28.11.2024 in OP.No.4922 of 2024 and she had deserted her erstwhile husband in the month of July 2021. Thereafter, she had never remarried. The petitioner would contend that she does not want to disclose the biological father of the child and she wants to bring up her child on

her own as a single mother. She also pleads that the law does not require the name of the father to be recorded in the birth entry. Therefore, she preferred an application on 10.08.2026 under Section 15 of the Registration of Births and Deaths Act, 1969 r/w. Rule 11 of the Tamil Nadu Registration of Births and Deaths Rules, 2025, to the respondents 1 to 3, by expunging the name of the sixth respondent and to issue a corrected birth certificate. In addition, the petitioner had applied through online portal of the respondent-Corporation. The same was received and acknowledged by the said respondents. The respondent had acted on the request of the petitioner and issued the birth certificate dated 09.08.2026 recording the name of the child as Dhanya, however, the correction sought by the petitioner to expunge the name of the sixth respondent in the birth certificate name remains undisposed to date. Hence the petitioner is before this Court.

4. Heard the learned counsel on either side and also perused the materials placed on record.

5. Considering the facts and circumstances of the case, a mandamus is issued to the respondents 1 to 5 to consider and dispose of petitioner's application dated 10.08.2026 in entirety, within a period of four weeks from the date of receipt of a copy of this order.
