PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling for the records of the impugned order passed by the 3rd respondent in Na.Ka.No. Aa1/3570/2024 dated 01.09.2025 and quash the same as illegal and thereby direct the respondents no.1 to 3 remove the encroachments that are made in Survey No. 591/1B situated at Kayamozhi village, Tiruchendur Taluk, Thoothukudi District.

2. According to the petitioner, there are encroachments in S.No.591/1B in Kayamozhi village. Even though the authority originally did not accept the petitioner's case, subsequently eviction order has been passed on 22.05.2026 under Section 6 of the Tamil Nadu Land Encroachment Act. Unless if the said order is not appealed, it shall be enforced by the third respondent. If any appeal is preferred, the rights of parties will abide by the same. We grant liberty to the petitioner herein to implead himself in any appeal that may be filed by the private respondents herein.
