ORDER

Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for Respondents 1 to 3. Since no adverse order is proposed to be passed against respondents 4 to 14, notice to them is dispensed with.

2. This Writ Petition has been filed for issuance of Writ of Certiorarified Mandamus, challenging the proceedings of the 1st respondent in Na.Ka.No.2675389/2024/A4 dated 09.09.2026 and consequently restore the patta bearing number 732 issued in petitioner's favour with regard to S.No.162/3A situated at Thoppampatti Village, Aathur Taluk, Dindigul District.

WP(MD) No. 29302 of 2026

3. The Division Bench of this Court, in the judgment reported in 1995 (1) MLJ 426, Kupusami v. District Revenue Officer, has categorically held that, where patta proceedings before the revenue authorities have attained finality, a Writ Petition under Article 226 of the Constitution of India cannot be entertained and that the aggrieved party should be directed to approach the competent Civil Court for appropriate relief.

4. In view of the above, this Court is of the view that, since the present Writ Petition challenges the patta proceedings which have culminated in the disposal of the revision petition by the higher authorities, the petitioner is at liberty to work out the remedy by instituting a civil suit before the competent Civil Court, instead of pursuing the present Writ Petition.

5. Accordingly, the Writ Petition stands dismissed, with liberty to the petitioner to approach the competent Civil Court.

6. However, the interim protection granted in this Writ Petition shall continue to remain in force for a period of twelve (12) weeks from the date of receipt of a copy of this order. If the petitioner fails to approach the competent Civil Court within the said period, the interim protection granted shall stand automatically vacated, without further reference to this Court.

WP(MD) No. 29302 of 2026 There shall be no order as to costs. Consequently, the connected miscellaneous petitions stand closed. 09-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No Nsr To:
