PRAYER: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ, Order or Direction more particularly in the nature of a WRIT OF MANDAMUS direction directing the Respondents 1 to 4
herein to consider the Petitioner s Representation dated 01.08.2025 and take appropriate action for removal of the encroachments by the 5th and 6th Respondents having their land in Survey Nos.296/29 and 296/30, 31 obstructing the access to Arulmigu Mariamman Temple in Survey No.296/5, Karumalai Village, Marungapuri Circle, Trichy District.

ORDER
(Order of the Court was made by G.R.Swaminathan J.) The writ petitioner submitted a representation dated 01.08.2025 seeking removal of encroachment in the petition mentioned pathway leading to Arulmighu Mariamman Temple in Karumalai village.
2. The photographs enclosed in the typed set of papers bare out the allegations of the writ petitioner. Any encroachment in a public pathway is impermissible and has to be necessarily removed.
3. We direct the third respondent to conduct survey. Notices shall be given to all the interested parties. If the survey results indicate that there are encroachments, the same should be removed by adhering to due process of law. The learned Special Government Pleader submitted that for want of assistance from the jurisdictional police, the encroachment could not be cleared. We direct the seventh respondent to offer effective police protection to the authorities concerned so that the encroachment can be removed. The entire exercise shall be completed within a period of four month from the date of receipt of a copy of this order. __________
