ORDER

The Revision Challenges the dismissal of the petitioner's application seeking transfer of amount, which is said to have been frozen in different financial bank accounts, pursuant to the deception practised on the petitioner by the accused.

2. The learned Magistrate had dismissed the application solely on the ground that the petitioner had stated that she was residing within the jurisdiction of the learned Magistrate only to invoke the territorial jurisdiction.

CRL RC No. 1921 of 2026

3. This Court had sought for a report from the police as to whether the petitioner is residing at the address mentioned by her.

4. The police have now filed a report stating that the petitioner is in fact residing at the address shown in the petition as a tenant.

5. Hence, the impugned order is set aside. The learned Magistrate shall consider the petitioner's application afresh on merits, within a period of two months from the date of receipt of a copy of this order.

6. Accordingly, the Revision is allowed. 01-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No TSG
