ORDER

The petitioner and the respondent have entered into a joint memorandum of compromise of settlement which is duly signed by them and also their

respective Counsel, dated 29.09.2026. The petitioner and the respondent are also present in person. An affidavit of the mother of the petitioner/husband, Mrs.Geetha Chakravarthy, dated 29.09.2026 is also filed to confirm the terms of settlement agreement between the petitioner and the respondent.

2. I have gone through the terms of settlement. The compromise also protects the interests of the two minor children. I have looked into the terms of compromise carefully and I find that the parties have adequately addressed the best interests and welfare of the minor children, daughter and son, respectively and Clauses regarding custody of legal, physical as well as maintenance of the minor children are also sufficiently covered.

3. One of the terms of compromise, Clause (b) at page 4, under the said compromise, is that the two minor children are being given, one flat each at the Alwarpet property, post joint development and in order to compensate the respondent/wife, towards her maintenance claims in full and final settlement, apart from the monetary claims that have been agreed upon in Clause (c). the petitioner has also come forward to transfer the property, which property stands settled in the names of the two minors, the petitioner father/husband, shall

represent the minor children as guardian, and shall execute a settlement deed on behalf of the daughter and son respectively to their mother, which is permissible under the provisions of the Tamil Nadu Stamp Act as well as the Registration Act, 1908. Any such document that is presented by the father/petitioner in terms of the compromise and this order shall be accepted for registration by the Sub Registrar concerned, without any objection or protest on the ground that the share of the minor children is being settled. I am satisfied that the settlement in favour of the mother is only in the larger interest of the minor children, since they are being given two new flats in the proposed development to be undertaken at the Alwarpet family property which would be better suited and in the best interests and welfare of the minor children.

4. In view of the parties also agreeable for amicably parting ways without battling their respective claims and contentions in the pending Family Court proceedings and in the light of the express terms agreed in the joint memorandum of compromise and terms of settlement dated 29.09.2026, OP. No.4592 of 2023, which has been suo motu withdrawn and transferred to the file of this Court stands allowed and a decree for dissolution of the marriage between the petitioner and the respondent is passed and the marriage between the petitioner and the respondent stands dissolved. O.P. No.4592 of 2023 is

ordered without reference to the merits or demerits of any of the allegations that have been stated against between themselves. O.P. No.456 of 2026, which has been filed for restitution of conjugal rights by the respondent/wife is dismissed. In view of the issue of maintenance and alimony, past, present and future, also being settled, and the compromise sufficiently covers the interest of the parties including the respondent/wife, M.C. No.629 of 2025 is also dismissed.

5. The property which is now under the occupation of parties at No.179, TTK Road, Alwarpet, Teynampet, Chennai - 600 018, which is proposed to be jointly developed through a builder of the choice of the petitioner/husband, belonging to his mother as on date, the mother has also been taken into confidence, since the father/petitioner has agreed to settle two flats in the proposed developments in favour of his two minor children, the daughter and son respectively. Hence, the grandmother of the minor children has also filed an affidavit affirming the settlement terms and expressing no objection for two flats, as agreed by the petitioner/husband, to be settled in favour of her minor grand children. The said affidavit dated 29.09.2026, shall also form part of the joint memorandum of compromise.

CONT P No. 2876 of 2026

6. In fine, the present Contempt Petition is closed. O.P. No.456 of 2026, dismissed, M.C. No.629 of 2026 is dismissed. O.P. No.4592 of 2023, is allowed granting dissolution of marriage, including the registered marriage between the parties as prayed for. The joint memorandum of compromise and terms of settlement dated 29.09.2026, shall form part of the order.
