ORDER
Heard Mr.S.Sridhar, learned counsel for the petitioner. The petitioner seeks Probate of the Last Will and Testament of late P.K.Rajagopal., who died on 26.12.2021 leaving behind his last Will and Testament dated 14.12.2021. The petitioner has been appointed as sole executor under the said Will and the original Will has been exhibited through the petitioner who examined himself as P.W.1, as Ex.P.3 and the death certificate of the deceased testator P.K.Rajagopal has also been filed as Ex.P.4.
2. The respondents are the beneficiaries under the said Ex.P.3 Will. The respondents, despite service of notice, including substituted service, have not come forward to object to the grant of Probate as prayed for by the petitioner, pursuant to his appointment as sole executor under the last Will and testament of P.K.Rajagopal.
3. The petitioner himself is one of the attesting witness to the said Will. Along with the original petition, the petitioner has also independently sworn to

affidavit of attesting witness dated 08.08.2022 where he has stated that the deceased testator is none else his maternal uncle and that he along with the other attesting witness Sri.LV.Krishnan were present at the time of execution of the said Will in Ex.P.3 and that the deceased testator was in a sound and disposing state of mind and that all witnesses including himself signed in the presence of the testator.
4. The affidavit satisfies the requirement of the mandate of Section 63(c) of the Succession Act read with 67 of the BNS 2023 (Section 68 of the Evidence Act, 1872).
5. The respondents have not come forward to file any caveat or object to the grant of Probate till date.
6. In the light of the above and on going through the evidence of P.W.1 oral and documentary as well as the petition averments and the affidavit of attesting witness, I am satisfied that the petitioner has made out a case for grant of Probate.
