ORDER

The present Writ Petition has been filed in the nature of a Writ of Mandamus seeking for a direction to the official respondents to cancel the erroneous Patta No.2234 in respect of 1 acre 26 cents in Old Survey No.818/2C and New Survey No.818/2C1 situated at Chitharevu, Village, Aathur Taluk, Dindigul District and issue a separate Patta in the petitioner’s name and other legal heirs on the basis of the petitioner’s representation dated 05.10.2026.

2. Heard the learned Counsel on either side. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage.

3. The petitioner has filed an application for cancellation of patta standing in the name of the fourth respondent on the strength of the title deed, which he had derived. Under Rule 4(4) of the Tamil Nadu Pata Pass Book Rules, 1987, the official respondents could not adjudicate upon the title that is claimed by the petitioner as against the 4th respondent in whose name the patta stands. The said principle has also been reiterated by the Hon’ble Apex Court in the judgment reported in 2021

(11) SCC 98, in the case of M/s. Edelweiss Asset Construction Company Limited v. R. Perumalswamy and others. In such view of the matter, the

Mandamus as sought for by the petitioner could not be issued.

4. In the result, the Writ Petition stands disposed of. There shall be no order as to costs. 30-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No cmr To
