(As per Hon'ble Mr. Varun Sindhu Kul Kaumudi, Administrative Member)

By this OA, the applicant has sought the following relief:

“a) Call for the relevant records concerning the implementation/review of Cycle (Maintenance) Allowance under RBE No. 115/2008, RBE No.93/2017 and RBE No. 44/2023 in South Central Railway, particularly in respect of Track Maintainer posts;

b) Direct the Respondents to consider and implement the Railway Board instructions contained in RBE No. 93/2017 as re-circulated by RBE No. 44/2023, in respect of eligible Track Maintainer posts/employees under South Central Railway, strictly in accordance with the terms and conditions prescribed therein;

c) Direct the competent authority to undertake a proper review of the relevant Track Maintainer posts under its control, as contemplated under paragraph 3 of RBE No. 93/2017, and determine eligibility for Cycle (Maintenance) Allowance;

d) Direct the Respondents to consider and dispose of the representations dated 23.10.2024 and 09.06.2026 by passing a reasoned and speaking order within a time-bound period;

e) Upon such determination, direct the Respondents to sanction and pay the Cycle (Maintenance) Allowance to the Applicant and other eligible similarly situated Track Maintainers, in accordance with RBE No. 93/2017 and other applicable instructions;

g) Direct the Respondents to ensure uniform consideration and implementation of the Railway Board's instructions across the concerned Divisions/Units of South Central Railway so that eligible similarly situated Track Maintainers are not discriminated against;

h) Pass such other order or orders as this Hon'ble Tribunal may deem fit and proper in the interests of justice”.

2. Learned counsel for the applicant states that employees like the applicant in the South Central Railway have been put to great loss on account of discrimination vis-à-vis similarly placed employees in other d l dil i@ il zones, like the East Coast, Central and North Eastern Railways, where the Track Maintainers are getting Cycle Maintenance Allowance, as given at Annexures - A6, A7, A8 and A9. He also presses upon the fact that the amount of the Cycle Maintenance Allowance has already been revised from time to time and is currently Rs.180/- per month. The Cycle Maintenance Allowance is covered by Rule 1606 of the IREC, Volume II, 2005 Edition. He has also submitted that even though the applicant and his colleagues have tried to submit representations to the Senior Section Engineer, SCR, who is their Supervisory Officer, he has declined to accept it.

3. It is also submitted by the counsel for the applicant that, even though the matter has also been taken up by the Dakshina Madhya Railway Karmik Sangh (DMRKS), no concrete steps have been taken up by the Principal Chief Personnel Officer (PCPO), South Central Railway.

4. Mr. K. Ravi Krishnakanth, learned Senior Panel Counsel, accepts notice on behalf of the Respondents and states that he would seek instructions in the matter.
