CENTRAL ADMINISTRATIVE TRIBUNAL PATNA Order Sheet Item no.: 17 C.P./23/2025 (PATNA) [ CONTEMPT ] [ SENIOR CITIZEN ] In O.A./638/2022 PENSION Court No.: 1 No of Adjournment: 9 Order Dated: 27/10/2026 SHIOJEE SINGH Vs POSTS

For Applicant(s) Advocate : Shri S.K. Tiwary.

For Respondent(s) Advocate : Shri T.N. Thakur, ld. Sr. CGSC. Order of The Tribunal Learned counsels for both the parties are present. Counsel for the respondents has submitted that against the Order of Tribunal, C.W.J.C. No.8279/2025 is pending before Hon’ble High Court. According to Order of Hon’ble High Court, above writ petition be listed after disposal of SLP (C) No. 28802-28804 of 2019 (Bhikhani Devi Vs. Union of India). It itself indicates that the matter is similar in nature as the case of Bhikhani Devi Vs. Union of India.

Counsel for the respondents has submitted that since the writ petition is pending before Hon’ble High Court, therefore, the proceeding in the present Contempt Petition be stayed. Counsel for the petitioner has strongly opposed and submitted that similar matter has been decided by Hon’ble Apex Court on 01.06.2026 and as per direction of Hon’ble High Court, the case be listed after disposal of case of Bhikhani Devi Vs. Union of India in SLP (C) No. 28802-28804 of 2019. Vide order dated 22.07.2026, on the request of counsel for respondents, an opportunity was given to obtain the stay order with regard to present proceeding but no order of Hon’ble High Court has been submitted by the counsel for the respondents in this regard. Mere pendency of a writ petition, cannot be a ground to stay the further proceeding of this Tribunal. Even, no application for adjournment has been filed by the counsel for the respondents. In view of above, we direct the counsel for the respondents to submit compliance report in four weeks, failing which, the Respondent No. 2/present incumbent shall present before this Tribunal. List the case on 15.12.2026. KUMAR RAJESH CHANDRA Member (A) Justice Narendra Kumar Johari Member (J)
