The Original Application having been heard on 14.10.2026, the Tribunal on the same day delivered the following: O R D E R (Oral):- Justice K. Haripal, Judicial Member The applicant is an Octogenarian, who retired as Stenographer Grade II way back on 31.01.1988, The grievance of the applicant is that even though he had retired from the pay scale of Rs. 1400-2300/-, while drawing Rs. 1600/- as last drawn basic pay, but the PPO was issued only taking pay at Rs. 1560/- in the scale of Rs. 1200-2040. Thereafter he was knocking at the doors of the respondents. Nothing was considered. At last he had moved the Nodal Appellate Authority. He has approached this Tribunal after all attempts failed to get the pension re-fixed in accordance with the last pay drawn, seeking the following reliefs:- “i) Set aside Annexure A-9 to the extent to which the pension of the applicant is fixed by adopting the pay scale of Rs. 1200-2040 instead of the correct scale of Rs. 1400-2300 as unjust, illegal and arbitrary.

ii) Declare that the applicant is entitled to revision of pension in accordance with the 6th and 7th Central Pay Commission recommendations based on his last drawn pay scale of Rs. 1400- 2300 manually to overcome technical difficulties in the SPARSH module and further that he is entitled to get interest on the delayed disbursement of pension due to him at the rate of 18% per

A X Sherin annum from the date of it actual due till the date of its actual disbursement.

iii) Direct the respondents to revise the pension of the applicant in accordance with the 6th and 7th Central Pay Commission recommendations based on his last drawn pay scale of Rs. 1400- 2300 manually to overcome technical difficulties in the SPARSH module and further direct them to disburse interest on the delayed disbursement of pension due to him at the rate of 18% per annum from the date of its actual due till the date of its actual disbursement.”

2. Respondents filed reply statement. Admitting the grievance raised by the applicant, it is submitted that Principal Controller of Defence Accounts (Pension) 'has already accorded approval for implementation of revision of basic pay of Rs.1600/- of the applicant in VIth and VIIth Pay Commission with Grade Pay of Rs. 2800/- and Rs. 31000/- respectively'. Copy of the order dated 14.02.2025 is enclosed as Annexure R-1. That means, the respondents have accepted the grievance of the applicant.

3. Learned Standing Counsel has submitted that the delay had occurred due to the technical error in the ‘SPARSH’ software. Qualifying service of five years could not be retrieved through SPARSH software. Such technical error has caused delay in rectifying the error. Now, the said error is being rectified manually.

The OA is allowed as above. No costs. (Dated, 14th October, 2026) BRAJ MOHAN AGRAWAL JUSTICE K. HARIPAL ADMINISTRATIVE MEMBER JUDICIAL MEMBER ax
