CENTRAL ADMINISTRATIVE TRIBUNAL MUMBAI Order Sheet Item no.: 13 M.A./1343/2025 (NAGPUR) [ CONDONATION OF DELAY ] In Diary No.: 3232/2025 REMOVAL Court No.: 1 No of Adjournment: 7 Order Dated: 26/10/2026 S V V S RAVI KUMAR Vs SOUTH EAST CENTRAL RAILWAY

For Applicant(s) Advocate : Adv. I A Fidvi For Respondent(s) Advocate : Adv. N P Lambat Order of The Tribunal We have heard ld. Counsel for the applicant and ld. Counsel for the respondents on application for condonation of delay.

2. Ld. Counsel for the applicant submits that the applicant has preferred this OA after 80 days of prescribed period of limitation of one year. Thus there is delay of 80 days in preferring the application. He submits that delay has been caused as his wife and father fell ill after the order passed by the appellate authority owing to which he was unable to pursue this litigation.

3. Ld. Counsel for the respondents submits that the delay has not been properly explained, therefore the application should be dismissed with costs.

4. On consideration of the arguments of ld. Counsels for respective parties, we find that delay is of 80 days and it has been properly explained by the applicant. From the medical certificates annexed herewith, it can be seen that on account of illness of his father and wife he was prevented from filing the Original Application within the prescribed period of limitation. Thus the applicant has made out sufficient cause for condonation of delay.

5. Application is therefore allowed and delay is condoned. MA No. 1343/2025 stands dipsosed of.

6. Original Application be registered if it is otherwise fit for registration. Stand over to Circuit Bench sitting at Nagpur in November, 2026. Sangam Narain Srivastava Member (A) Justice M.G.Sewlikar Member (J) C Kumar ( court master )
