O R D E R

PER HON’BLE JUSTICE ANIL KUMAR OJHA, MEMBER (J) Heard learned counsel for the applicant, learned counsel for the respondents and perused the records.

2. At the outset, learned counsel for the respondents drew our attention towards the judgment dated 17.09.2026 passed by Hon’ble High Court in Writ-A No. 9060 of 2026- Union of India & Ors. vs. Ram Swaroop wherein it has been held that O.A. No. 362 of 2026 i.e. the present O.A. has been rendered infructuous and the same has been dismissed as infructuous. Further contended that this OA be dismissed as having become infructuous in view of the aforesaid judgment of the Hon’ble High Court.

3. To this, learned counsel for the applicant conceded the aforesaid fact situation, however, argued that the conduct of the respondent department is malafide. Further urged that applicant may file fresh O.A. for redressal of his grievances showing the misconduct of the respondents.

4. The relevant portions of the judgment dated 17.09.2026 passed in Writ-A No. 9060 of 2026 by Hon’ble High Court are quoted herein below:- “5. Learned counsel for the respondent has fairly submitted that fresh developments have taken place subsequently in as much as the fresh order for transfer has been passed on 21.8.2026 and in pursuance to the said the respondent has already joined at Varanasi.

6. It is in the aforesaid circumstances, the respondent has fairly submitted that the said original application has been rendered infructuous.

7. It is in the aforesaid circumstances considering the fact that subsequent order of transfer has been passed on 21.8.2026 in pursuance to which the respondent has already joined at Varanasi and therefore his grievance against the order dated 10.06.2026 no longer subsists, accordingly with the consent of parties the Original Application No. 362 of 2026 preferred by the opposite party has been rendered infructuous and the same is dismissed as infructuous. As the original application has been rendered infructuous and is dismissed, any interim order passed therein also stands discharged.”

5. From the perusal of Para 7 of the aforecited judgment of the Hon’ble High Court, it is manifest that the Hon’ble High Court has dismissed the present O.A. as infructuous.

6. In view of the above, this O.A. is disposed of in the light of judgment of the Hon’ble High Court in Writ-A No. 9060 of 2026 on 17.09.2026. There is no order as to costs. Associated MAs also stand disposed of accordingly.
