2. This Review Application has been filed by the applicant against the order dated 11.11.2025 passed in the Original Application No. 255 of 2021 by which the applicant was notionally reinstated into service and thereafter granted service pension.

Submission of the learned counsel for the applicant is that as per judgment and order dated 11.11.2025, the applicant has not been paid salary for 14 months for the period from December 2018 to January 2020, though it was mentioned in the relief clause (b) of the Original Application, i.e. ‘Issue/pass an order directing the respondents to consider case of the applicant for reinstatement and continuity in service with all consequential service benefits including correct fixation and payment of salary in the band Pay of Rs. 35,100/- along with arrears, and promotion in the rank of Lance Defedar from the date his junior were promoted’, and hence, there is an apparent error on the face of record of the said judgment and order dated 11.11.2025 to the extent of non dealing with and deciding the matter relating to non payment of salary to the applicant for the period he served after taken on strength on 13.12.2018. He further submitted that the respondents in their counter affidavit has admitted in Para 30 read with Annexure No. CA-16 that the applicant was not paid salary for 14 months from December 2018 to January 2020.

4. Legal Representative, present before the court verbally submitted that 14 months salary from December 2018 to January 2020 has been paid to the

applicant which is reflected in the Pay Slip of January 2021 to which learned counsel for the applicant denied stating that no such payment has been received by the applicant.

5. During the course of hearing, the court observed that this particular relief stating that the applicant has not been paid salary for 14 months for the period from December 2018 to January 2020 has not been reflected clearly in the prayer clause, so, for this particular relief, applicant may file fresh O.A. before this Tribunal to which learned counsel for the applicant prayed to dispose of this Review Application and grant liberty to the applicant to file fresh O.A. raising this particular relief of non payment of 14 months salary to the applicant.

6. We, therefore, direct the applicant to take up case with the Army authorities for release of payment of 14 months salary for the period from December 2018 to January 2020 through a representation and in case his grievance of non payment of 14 months salary is not redressed by the respondents, then the applicant will be at liberty to approach this court to raise his grievance of non payment of 14 months salary by filing a fresh Original Application.

7. With the aforesaid observation/direction, this Review Application is disposed of.

8. Pending Misc. Application(s), if any, shall stand disposed of.
