2. Heard learned counsel for the parties and perused the record.
3. The matter regarding shortfall in service has already been settled by the Hon’ble Apex Court in the case of Union of India and others Vs. Balakrishnan Mullikote arising out of Diary No. 27246 of 2023 decided on 24.3.2026. In the present case there is only short fall of 5 months and 11 days in completion of 15 years in DSC service. The O.A. was allowed 16.12.2022 with direction to the respondents to grant second service pension to the applicant from the date of his discharge and thereafter, the Hon’ble Apex Court has also clarified that the matter byway of deciding the case of Union of India and others Vs. Balakrishnan Mullikote (supra). Even then, the respondents are not ready to comply with the order passed by this Tribunal on 16.12.2022 in O.A. No. 676/2022.
4. Ld. Counsel for the respondents is of the view that as the review application has been filed against the judgment in the case of Union of India and others Vs. Balakrishnan Mullikote (supra), respondents are in hesitation to comply with the order dated 16.12.2022 of this Tribunal.
5. Mere filing of the review application, on separate and distinct ground, there is no ground to deny the compliance of the order of this Tribunal, which is inconsonance with the judgment of Union of India and others Vs. Balakrishnan Mullikote (supra).
6. In view of the above, we are of the view that a cost of Rs. 25,000 may be imposed upon the respondents payable by the next date. Accordingly, a cost of Rs. 25,000 is imposed upon the respondents, payable by the next date. We also direct the SRO (Record) to appear through virtual mode on the next date to explain for non compliance of the order and why the contempt proceeding may not be initiated against the responsible officer of the respondents. Meanwhile the compliance report may be filed by the respondents, preferably within one month.
