ORDER

The applicant was discharged on 28.02.2018 on completion of his tenure. He was in a Permanent Low Medical Category on account of disabilities of (a) ‘Mangled Extremity Amputation (RT) Lower Limb’, the extent of which was assessed to be 70% and attributable to military service, (b) ‘Compound Fracture Femur (RT) with Bone Loss (OPTD)’, the extent of which was assessed to be 20% and attributable to military service and (c) ‘Compound Fracture (RT) Humerus with Implant Failure (OPTD)’, the extent of which was also assessed to be 20% and attributable to military service. The Release Medical Board assessed the composite extent to be 80% for life. Claim for grant of disability element has, however, been rejected by the competent authority by finding that the disabilities were neither attributable to nor aggravated by military service.

Learned counsel for the applicant has relied upon a judgment of the Hon’ble Supreme Court in CA No.164 of 1993 Ex-Sapper Mohinder Singh Vs Union of India and others decided on 14.01.1993, to submit that the
