IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA. CWP No. 9450 of 2014 Decided on: 31.12.2014 Krishan Chand.

….Petitioner

versus State of H.P. & another.

….Respondents. ___________________________________________________________

Coram

The Hon’ble Mr. Justice Sanjay Karol, Judge. The Hon’ble Mr. Justice P.S. Rana, Judge. Whether approved for reporting or not?1 No For the petitioner: Mr. Lalit K. Sharma, Advocate. For the respondents : Mr. Shrawan Dogra, Advocate General with Mr. V.S. Chauhan, Additional Advocate General and Mr. Vikram Thakur, Deputy Advocate General, for respondent No.1.

--------------------------------------------------------------------------- Sanjay Karol, Judge (Oral)

No doubt, we find that petitioner’s transfer stands effected on the basis of a D.O. Note, but record also reveals that there is serious complaint of financial irregularities against him, which perhaps weighed with the authorities for transferring the petitioner from his original place of posting. As such, in equity, we see no reason for interfering with the impugned order of transfer. Petition is dismissed, so also the pending applications, if any.
