ORDER
1. Learned counsel for petitioner submitted that respondent has already filed reply and looking to the Paragraph no.5 of the reply filed by the respondent, there are two types of dues which are mentioned by the respondent: one in part-A and another in part-B.
2. It is submitted by the learned counsel for the petitioner that so far as part-B dues are concerned, the matter is already pending before Hon'ble the Supreme of Court of India in which stay has already been granted and this factual matrix has been admitted by the counsel for respondent. So far as part-B dues are concerned, now, the question left out is about the dues which are to be paid by petitioner to the respondent as mentioned in part-A which is at Rs.2,63,999/- as on 30.09.2026.
3. It is submitted by the learned counsel for petitioner that without prejudice to the rights and contentions of the petitioner, at this stage, petitioner is ready and willing to make payment of Rs.2,63,999/- to the respondent and they shall apply for fresh licence which is known as UL-ISP. This fresh application for getting UL-ISP licence may be decided by the respondent in accordance with law.
4. Learned counsel appearing for Union of India submitted that let the amount mentioned in part-A at Rs.2,63,999/- be deposited by the petitioner and let the petitioner apply for fresh licence - UL-ISP and as and when such application for fresh licence is preferred, the same will be decided in accordance with law.
5. In view of these submissions, if the petitioner is depositing Rs.2,63,999/- within a period of three weeks before the concerned authority of Union of India and thereafter petitioner may prefer fresh application for getting the licence known as UL-ISP for any of the categories. As and when such application is preferred by the petitioner for getting the fresh licence, the same will be decided by the Union of India in accordance with law, but, this application shall not be rejected by Union of India only on the ground that present TP 19/2026 is pending before this Tribunal. Thus, the decision will be independent of pendency of the present TP 19/2026.
6. This matter is adjourned on 27.01.2027.
