ORDER

1. We have heard learned Senior Counsels Mr. Parag Tripathi and Mr. Jayant Mehta at length on behalf of petitioner who have pointed out the legal position as on today so far as the maintenance of LCN number, LCN rank etc. is concerned. Learned Senior Counsels for the petitioner have taken this Tribunal to the various Annexures annexed including Annexure-P/2 and Annexure-P/7 to the memo of this Broadcasting Petition and it is submitted by the learned Senior Counsels for the petitioner that there is no legal obligation on the part of the petitioner to maintain LCN number, LCN rank etc. after the period of one year is over. As per the petitioner one year is over already in the month of September, 2026. This factual aspect has been denied categorically by the respondent especially keeping in mind Annexure-P/2 which is a new SLA entered into between the parties to this litigation in March,2026.

2. Learned Senior Counsels for the petitioner voluntarily submitted that to get the stay against the Disconnection Notice at Annexure-P/7 which is dated 06.10.2026, petitioner is making a statement at bar that petitioner shall maintain (i) LCN number for all the channels of the respondent; (ii) LCN rank of all the channels of the respondent; and (iii) they shall fulfill all the conditions as mentioned in Annexure-P/2 which is the new SLA entered into between the parties to this litigation in March, 2026 so that petitioner is entitled to get the incentives from the respondent in accordance with Annexure-P/2 the new SLA.

3. It is submitted by learned Senior Counsels for the petitioner that the aforesaid maintenance of LCN number, LCN rank etc. shall be without prejudice to the rights and contentions of the present petitioner. It is further summitted by the learned Senior Counsels for the petitioner that because of unequal bargaining power with respondent, there is no option to the petitioner but to enter into a new SLA at Annexure-P/2 which shall be argued out at length at the time of final hearing.

4. In view of the aforesaid statement to maintain LCN number, LCN rank and other conditions as mentioned at Annexure-P/2 - new SLA entered into between the parties to this litigation, we hereby stay the operation, implementation and execution of the Disconnection Notice issued by the respondent dated 06.10.2026 at Annexure-P/7.

5. We make it explicitly clear that the aforesaid concession given by Mr. Parag Tripathi, learned Senior Counsel on behalf of his client is without prejudice to their rights and contentions to be decided at the time of final hearing of the matter and the statement is made only for the interim arrangement between the parties to this litigation.

6. This stay shall come in operation immediately upon the restoration of the LCN number, LCN rank and other conditions mentioned at Annexure-P/2 which is the new SLA. This stay shall remain in operation, during the pendency and final hearing of this Broadcasting Petition.

7. Learned counsel for the petitioner submitted that they want to file rejoinder-affidavit within a period of two weeks. The time, as prayed for, is granted to file rejoinder-affidavit to the petitioner.

8. Registry of the Tribunal is directed to enlist this Broadcasting Petition under the heading "For Hearing" on 22.12.2026.
