ORDER
When the matter is taken up, learned counsel for the petitioners submitted that CRP 5098/2026 is not listed before the Hon’ble High Court of Madras
2. On 20.08.2026, this Tribunal directed the petitioners to produce orders, if any passed by the Hon’ble High Court of Madras in CRP 5098/2026 filed against the order passed in the waiver application. It was made clear that failing to produce the stay order if any granted by the Hon’ble High Court of Madras would result in passing consequential orders in the waiver application and the matter was adjourned to 21.09.2026. Since there was no sitting on 21.09.2026, the matter was adjourned to today.
3. Learned counsel for the petitioners submitted that CRP 5098/2026 is not listed so far.
4. In view of non-production of any order passed by the Hon’ble High Court of Madras in CRP 5098/2026, the waiver application is dismissed for non-compliance of the conditional order passed on 21.07.2026 and the appeal in AIR (SA) 123/2026 is rejected. Parties shall bear their own costs. Pending IAs, if any shall stand closed.
