1. Present as under:
Mr. Prashant Pandit along with Mr. Jay Pandit, Counsel for Appellant. Mr. Zulfiq Multani and Mr. Manoj Mishra (through VC), Counsel for Respondent No.1/Bank.
2. The matter is taken up for hearing by way of praecipe filed by the appellant for seeking urgent relief.
3. The Learned Counsel for Respondent No. 1/Bank seeks time to file its reply to the grounds of appeal as well as to the Interim Application. He would further submit that the Respondent No.1/bank will give at least 15 days-notice to the Appellant, if any measures are taken for taking possession of the secured asset.
4. The Appellant is directed to furnish a copy of the memo of appeal and the Interim Application if not already supplied to the Learned Counsel for Respondent No. 1/Bank.
5. List the case on 09.02.2027 for hearing.
6. The Respondent No.1/Bank shall be bound with the undertaking stated in para 3 above Sd/- Chairperson 02.11.2026 Psa-03
