1. The present CP has been filed alleging wilful defiance of the directions of the Tribunal contained in the order dated 20.04.2026. The last two paragraphs of the said order, while posting the matter to 18.05.2026, read as under: "Since the inquiry is stated to be in progress, learned counsel for the applicant, at this stage, seeks interim protection by way of stay of the inquiry proceedings.
In this regard, we grant liberty to the applicant to move an appropriate application before the Inquiry Officer seeking adjournment. In the event such an application is made, the Inquiry Officer shall consider the same and adjourn the proceedings suitably, in accordance with law."
2. Mr. Chauhan, learned counsel for the applicant, submits that despite the aforesaid order having been brought to the notice of respondent No. 3, and despite the applicant’s application seeking adjournment, respondent No. 3 has passed the order dated 25.09.2026, paragraphs 7 to 12 of which read as under: "In view of the above, the Inquiry Authority has decided to proceed with the inquiry ex-parte against the Charged Officer. The Presenting Officer is accordingly directed to produce his statements, records, documents, witness in support of the charges framed against the Charged Officer.
Accordingly, the next date of hearing is fixed on 05.10.2026 at 11:00 AM at the Office of the Welfare Commissioner (C), Ministry of Labour & Employment, LWO Jabalpur, 797 Shanti Kunj, South Civil Lines, Jabalpur-482001 (?.?.).
The Presenting Officer shall remain present on the aforesaid date and time and shall produce the documents, evidence and witness(es) in support of the articles of charges framed against the Charged Officer.
The Charged Officer is directed to remain present on the next date and time of inquiry before the Inquiry Officer and have the opportunity to cross examination of the witness (es) produced by the Presenting Officer. If the Charged Officer will not present on the next date of hearing he will lost the opportunity to cross examination of the witness (es), it may be noted."
3. From the aforesaid order dated 25.09.2026, it is apparent that despite the categorical direction to respondent No. 3 to adjourn the proceedings upon receipt of the applicant’s application in this regard, the Inquiry Authority has proceeded with the impugned departmental inquiry.
4. Prima facie, the action of respondent No. 3 is found to be contemptuous. However, showing indulgence at the request of learned counsel for the respondents, the hearing of the matter is deferred to 05.11.2026 in order to enable him to take necessary instructions.
