With reference to the order passed on 05.01.2026, an affidavit has been filed on 07.10.2026 by the respondents. Learned counsel for the respondents has cited paras No. 5 to 11 of the same. From the service records, it appears that, at the time of joining, in his service book, full details, including his permanent address, etc., were not filled up, even though it was countersigned by AEN (C) V/SC. Learned counsel for the respondents has argued that, even in his appeal, dt. 24.03.2012, he has failed to mention his address along with his contact number. It is noticed that the officers responsible for getting the details, even at the time of acknowledgment of the appeal, have not bothered to seek the basic information from him. The appeal is in English, whereas Mr. Gowraiah has signed in vernacular. As a Trackman/removed Trackman, he was in no position to request the authorities to provide or incorporate information. Learned counsel for the applicant argues that it is not disputed that the penalty orders were not served on the applicant/charged officer, Mr. K. Gowraiah. He has pleaded that his case may be considered on the lines of the order, dt. 08.10.2026, in OA/621/2022, specially at para 13. Orders reserved.
