CENTRAL ADMINISTRATIVE TRIBUNAL HYDERABAD (TELANGANA) NO. 5-10-193, 1ST FLOOR, HACA BHAVAN,HYDERABAD - 500004 Order Sheet Item no.: 5 O.A./752/2023 (ANDHRA PRADESH) [ CASUAL LABOUR ] [ SENIOR CITIZEN ] Court No.: 2 No of Adjournment: 22 Order Dated: 29/10/2026 K SATYANARAYANA RAO Vs SOUTH CENTRAL RAILWAY
For Applicant(s) Advocate : T SAMBASIVA RAO
For Respondent(s) Advocate : V VINOD KUMAR Order of The Tribunal Learned counsels for the parties are present. Learned counsel for the respondents has argued today that, when the matter was discussed by the Pension Adalat, the Supreme Court judgment in the Rakesh Kumar case had not been pronounced, and the subsequent Tribunal judgment cannot be relied upon by the applicant now. According to the counsel for the applicant, at the time of retirement, on 31.07.2012, his service was shown as 24.5 years. The same has been considered as 25 years in the PPO at A-7, and there is an admission on the part of the department, on 15.12.2015, vide Annex-A5 regarding the correct length of service. Hence, he has to be treated as entitled to the benefit of casual service as at Annex-6, pg 18.
Learned counsel for the respondents furnished a copy of instructions, dt. 11.06.2026, stating that Rule 31 of the RS (Pension) Rules, relied upon by the Hon'ble Supreme Court, has been superseded by the CCS (Pension) Rules, 1972. He also states that having retired in the year 2012, the applicant cannot rake up the issue at this belated stage. The representation purportedly submitted on 27.11.2012 remains without any indication of acknowledgment. Therefore, according to the counsel for the respondents, casual service cannot be considered for pensionary benefits. Orders reserved. Varun Sindhu Kul Kaumudi Member (A) K Adilaxmi ( court master )
