PER: DR. SANJIV KUMAR, MEMBER (A)
This Contempt Petition is filed by the petitioner alleging breach and wilful disobedience of the order dated 07.10.2025 passed by this Tribunal in OA 300/2025.
2. The grievance of the petitioner is that the order spoke of that the respondents are directed to declare the result of the applicant in the Limited Departmental Competitive Examination (LDCE) held on 10.01.2021 by opening the sealed cover and provide all consequential benefits to the applicant accruing thereof. The petitioner submits that the respondents have opened the sealed cover and put him in the promotional post and have given notional salary and increments and seniority from that date of retrospective promotion but not given actual benefits of arrears.
3. The main contention of the respondents was that no arrears was specifically mentioned thereof, hence, they have implemented the order in spirit as the order was not clear on the matter. Hence, the petitioner filed a clarificatory Miscellaneous Application No. 373/2025 and now in this MA, following is ordered:
TARU LATA
TARU LATA
“Order: It is hereby clarified that the generic expression "All Consequential Benefits" in the order dated 07.10.2025 passed in OA No. 300/2025 does not, in the facts and circumstances of the case, include financial benefits or back wages, as the same were not expressly directed therein.
2. Miscellaneous Application No. 373/2026 stands disposed of accordingly.
3. There shall be no order as to costs.”
4. As the only remaining contention of the Applicant in this Contempt Petition was that the respondents have given him all other retrospective benefits except the fnancial benefits hence, to take action against the Respondents under the contempt provisions, and in the light of the clarification issued under MA No. 373/2026 in OA No. 300/2025, no such issue remains to be addressed now.
5. Accordingly, Contempt Proceedings are dropped.
6. Notices are discharged. No order as to costs.
