O R D E R (ORAL)

PER: JUSTICE S. SUJATHA, MEMBER (J)

Though the matter is listed for orders, with the consent of the learned counsel appearing for parties, the matter is taken up for final disposal.

2. This application is filed by the applicant under Section 19 of the Administrative Tribunals Act, 1985 seeking the following reliefs:

“(a) Call for records of the case from the respondents and on perusal (b) Issue a direction to the appellate authority to dispose of the appeal dated 17.4.2026 submitted by the applicant without any further loss of time.

(c) Grant such other relief as this Hon’ble Tribunal deems fit to grant to the applicant in the circumstances of the case including an order as to costs of this application in the interests of justice”

3. The applicant who was working as Senior Office Associate in Bijapur Telecom District was suspended on the ground of contemplation of disciplinary proceedings on 23.07.2025, which came to be revoked on 26.09.2025. The applicant was transferred to Belgaum Telecom District. Prior to the revocation of suspension, the Disciplinary Authority issued a charge memorandum dated 03.09.2025, to which the applicant submitted his reply, culminating in the order imposing the penalty of compulsory retirement. Being aggrieved, the applicant preferred an appeal before the Appellate Authority i.e., the Respondent No. 1 herein on 17.04.2026. Since the said appeal was not disposed of even after the lapse of more than four months, a legal notice was issued by the applicant requesting for early disposal of his appeal but to no avail. Hence, this OA.

4. The failure on the part of the Appellate Authority to discharge his mandatory duties within a reasonable time being ex- facie apparent, it is suffice to issue a direction to the 1st respondent to dispose of the pending appeal dated 17.04.2026 (Annexure A2) submitted by the applicant against the order of penalty dated 02.04.2026 imposed by the Disciplinary Authority, in accordance with law, as expeditiously as possible within a period of six weeks from the date of receipt of certified copy of this order. Ordered accordingly.

5. OA stands disposed of in terms of above. No order as to costs.
