CENTRAL ADMINISTRATIVE TRIBUNAL BANGALORE Order Sheet Item no.: 9 M.A./279/2026 (BANGALORE) [ FOR AMENDMENT ] [ SENIOR CITIZEN ] In O.A./181/2025 MAJOR PENALTY Court No.: 1 No of Adjournment: Order Dated: 03/11/2026 T RADHAKRISHNAN Vs DEPARTMENT OF PERSONNEL AND TRAINING AND OTHERS
For Applicant(s) Advocate : Shri Jayanth Dev Kumar For Respondent(s) Advocate : Smt. P.K. Praneshwari for Respondent No. 1 through video conference, None for Respondent Nos. 2 and 3 Order of The Tribunal MA No. 279/2026 (For amendment) This MA is filed by the original applicant seeking for amendment of the OA, to challenge the order dated 25.03.2026 (Annexure A20) passed by the 1st respondent and grant all consequential reliefs. It is asserted by the learned counsel for the applicant that the Review Petition submitted by the applicant against the order of the Disciplinary Authority has been dismissed during the pendency of the present OA, hence, it is necessary to challenge the said order of dismissal of the Review Petition by the Disciplinary Authority which is a subsequent development. Accordingly, seeks for amendment as sought for. Learned counsel Smt. P.K. Praneshwari representing the Respondent No. 1 would submit that the order dated 25.03.2026 rejecting the Review Petition was issued after considering the facts and grounds as well as the relevant records pertaining to the disciplinary proceedings. Hence, it is not necessary to permit the applicant to amend the OA which would amount to changing the nature of the OA itself.
Having heard the learned counsel for the parties and perusing the material on record, it is not in dispute that the Review Petition filed by the applicant against the order of the Disciplinary Authority has been dismissed on 25.03.2026 during the pendency of the present proceedings. The same being subsequent development, it is necessary to permit the applicant to amend the OA to challenge the said order as well which is nothing but the continuation of the proceedings of the Disciplinary Authority. The same, at any stretch of imagination, would not change the nature of the OA. Accordingly, MA is allowed allowing the applicant to amend the OA as sought for. Amended OA shall be filed by two weeks. OA No. 181/2025 List the matter on 01.12.2026.
